Beginning October 1, 2026, under the Alabama Living Donor Protection Act, an eligible college employee may be granted paid living donor leave for donating an organ or bone marrow upon the fulfillment of conditions set forth in this section.
Eligibility: Eligibility shall be determined by the College’s human resources office. To be eligible for living donor paid leave, a college employee meet all three requirements:(1) the employee must be permanently employed, (2) the employee’s compensation must be derived in whole or in part from funds appropriated in the State General Fund or Education Trust Fund, and (3) the employee must have at least one year of current service with the college. “Permanently employed” personnel do not include part-time, as needed, occasional, and other temporary personnel, but it does include those on Salary Schedules B, C, D, E, H.
An example of a college employee whose compensation is not derived in whole or in part from funds appropriated in the State General Fund or Education Trust Fund would be a worker whose complete salary and benefits (100%) are covered by a third-party which also does not obtain its funding from the State General Fund or Education Trust Fund.
Conditions: To maintain eligibility for living donor leave, the employee must fulfill the following conditions: (1) Submit written request for leave to the employee's supervisor, accompanied by written verification from the physician who will be performing the medical procedure detailing the date of the procedure and the type of procedure (organ or bone marrow); (2) Receive a recommendation for approval for the leave from the supervisor; and (3) Receive approval of the leave from the President (or his/her designee).
Leave Rules:
- Eligible employees may be granted up to 30 days of living donor leave with pay for donating an organ.
- Eligible employees may be granted up to 7 days of living donor leave with pay for donating bone marrow.
- Living donor leave may only be taken consecutively from the date of the medical procedure: intermittent leave is not available.
- Living donor leave shall be a separate classification of leave which shall not apply to or exhaust an employee's accrued or available leave.
- The college may not retaliate or discriminate against an employee for requesting or using living donor leave.
- Any supervisor who denies an employee living donor leave must provide written justification to be reviewed by the President (or his/her designee).
